A. General
1. Ownership: Tens-Hire.co.uk is an on-line trading division of Thamert (UK) Ltd., a limited registered company, Reg. No. 3017288, established at its registered office at 4 South Bar, Banbury, Oxon, OX16 9AA, who is the owner of this site. By using this website you signal your agreement to be legally bound to its Terms and Conditions.
References to ‘you’ and ‘your(s)’ on this site refer to the accessing user.
References to ‘we’, ‘us’ and ‘our’ on this site refer to Tens-Hire-Shop.co.uk
2. Terms: All products featured on this site are subject to the terms and conditions governing their use. Please read these terms carefully, taking note of any disclaimers provided. We reserve the right to change, i.e., add to, take away from or make modifications to, any part of this site, without serving notice.
3. This website is the only and exclusive distribution channel for products and services that are on offer under the Tens-Hire.co.uk identity. You are permitted to use this website for personal purposes only. The site is intended for UK and Republic of Ireland based customers only.
4. Links: You must not set up or operate links to this website or any of its constituent parts or sections without prior permission in writing from the Directors of Thamert UK Ltd.
Links that we may provide to third party websites are for information purposes only, and should not be seen as endorsing the contents of any of those sites. Tens-Hire.co.uk is not responsible for any content of any third-party site.
5. Although Tens-hire operates a secure server and payment route, internet messages can never be completely secure. We are not responsible, or liable to you, for any damages or loss incurred as a result of using this site.
6. Intellectual property: All information and data displayed on this website, including the Tens-Hire.co.uk logo, are subject to intellectual property rights.
7. Applicable law and jurisdiction: Any disputes arising as a result of using this website including these Terms and Conditions are governed by English law.
B. Tens Machine specific
1. The TENS machine is supplied on the understanding that it will be used only by the person whose name appears on the booking form and is not transferable between individuals.
2. The person hiring the unit should have discussed the use of a TENS machine with the medical practitioner in charge of their care and will have received the practitioners approval.
3. TENS will be used under medical supervision and guidance following the instructions provided.
4. The success of TENS cannot be guaranteed.
5. The TENS unit will be supplied to the best of our ability in perfect working order ready for use.
6. TENS should not be used by anyone suffering from epilepsy, fitted with a cardiac pacemaker or who suffers from (or is suspected of suffering from) heart disease.
7. Tens-Hire.co.uk reserves the right to charge the replacement value of lost, stolen or damaged TENS units or part of a unit. The replacement cost may be charged if any TENS unit or part of a unit is returned contaminated with bodily fluids.
8. Tens-Hire.co.uk shall not be held responsible or liable for any injury or damage sustained as a result of misusing our TENS unit.
9. The return of the TENS unit to Tens-Hire.co.uk rests with the hirer. A certificate of posting is to be obtained for all return packages and the receipt retained for a period of one month as proof of posting.
10. The hire period is for three weeks (6 weeks for childbirth units, see additional terms below). Should the unit not be returned by the last day of the rental period (unless otherwise agreed with Tens-Hire.co.uk), an additional £5 will be charged for each week or part of additional week that the unit fails to be returned. If the TENS is not returned for any reason, all outstanding sums will be automatically charged to the customers credit or debit card.
11. Extension of the hire period must be agreed with Tens-Hire.co.uk. Any unauthorized extension of the hire period is not permitted and may be subject to the additional charges mentioned in point 10.
12. In the event of a cancellation the rental fee will be returned less an administration fee of £5. No refund will be made after the TENS unit has been dispatched to the hirer, or for non-use of a machine.
13. All Tens-Hire.co.uk TENS rental units are tested immediately prior to dispatch. However the liability of Tens-Hire.co.uk shall not exceed the hire charge.
14. Tens-Hire.co.uk cannot be held liable for the Royal Mail not delivering in line with their published services.
15. Tens-Hire.co.uk reserves the right to alter Terms and Conditions of hire without prior notice.
TENS for Childbirth Additional Terms & Conditions:
TENS units rented for childbirth are let out on a six week rental agreement.
An extension of 1 week to the six week hire period can be accommodated at no extra cost if agreed prior to the expiry date of hire with Tens-Hire.co.uk.
TENS electrodes should be placed on the back according to the instructions during labour and can be placed on limbs during testing or practice after 37 weeks of pregnancy. Electrodes should not be placed on broken or inflamed skin.
Obstetric TENS units are dispatched to arrive 3 weeks prior to the baby’s due date. Advance bookings are welcome.
It is the responsibility of the customer to check the contents of the hire package upon receipt and familiarise themselves with the TENS machine and user instructions. The customer must advise Tens-Hire.co.uk of any problems whatsoever immediately. Tens-Hire.co.uk accepts no responsibility where the customer fails to do so and renders it impossible for Tens-Hire.co.uk to take any corrective action.
Ex-Rental Childbirth TENS Purchase Details & Guarantee:
The guarantee provides 3 months cover (from the date of delivery) for the TPN400D TENS unit, when purchased as an ex-rental machine. Should a fault occur with the unit during this period, the machine will be replaced with another ex-rental machine free of charge. The guarantee only applies to the actual TENS unit.
Sale package consists of a refurbished TPN 400D Labour TENS machine, two lead wires, one new set of four electrodes, two batteries, one armband and full instructions.
